CapitalOne assets blocked

On 15 July 2019, the Securities Commission ordered blocking of assets on cash accounts and securities accounts of broker-dealer company CapitalOne a.d. Beograd, for a period of three months.

The Commission adopted a decision establishing that all the requirements under Article 205, paragraph 1, point 4) of the Capital Market Law had been met to impose a measure prohibiting disposition of funds on cash accounts and securities on securities accounts to the broker-dealer company CapitalOne a.d. Beograd, with the registered office in Belgrade, Svetog Save 34a (RN 20293560, TIN 105007814). Therefore, an order was issued to block the assets on cash accounts and securities accounts of the company for a period of three months starting on 15 July 2019.

In its supervision procedure the Commission had established illegalities and on 10 May 2019 the Commission suspended all the activities of CapitalOne instructing it to eliminate the determined illegalities.

As the company had not complied with the instructions, the Commission adopted a new measure – suspending its license for the provision of activities of an investment firm of CapitalOne for the period of 6 months.

As CapitalOne failed to comply with the statutory requirements, the value of assets it kept for the clients and the extent of its liabilities to the clients cannot be established.

The Commission hereby invites all the CapitalOne clients who believe they have been incurred damages by CapitalOne to write to the Commission to the email address nadzor@sec.gov.rs, by 15 September 2019.
